These Terms of Service govern your use of Armidale Community Garden's Landscaping services and website. By accessing our services, you agree to these terms. Please read them carefully, as they outline your rights and responsibilities, as well as our commitments to you.
Acceptance of Terms
By engaging Armidale Community Garden for Landscaping services or using our website, you accept these Terms of Service in full. If you disagree with any part, you must discontinue use. These terms apply to all consultations, estimates, projects, and digital interactions with our company.
Service Description
Armidale Community Garden provides professional Landscaping services including design, installation, maintenance, and related horticultural work. All services are performed by our trained staff in accordance with industry standards and the specific agreements outlined in your project proposal. We reserve the right to modify or discontinue services at our discretion.
Estimates and Agreements
Quotes provided are estimates based on initial assessments and may be adjusted if site conditions change or additional work is requested. A formal service agreement, detailing scope, timeline, costs, and payment terms, must be signed before work begins. Verbal agreements are not binding unless confirmed in writing.
Payment Terms
Payment is due as specified in your service agreement, typically with a deposit upon signing and the balance upon completion. We accept various payment methods, and late payments may incur fees or suspend service. All prices are in local currency and exclude applicable taxes unless stated otherwise.
Cancellation and Refunds
You may cancel a scheduled service with at least 48 hours' notice without penalty. Deposits for custom Landscaping projects are non-refundable once materials are ordered or work has commenced. If we cancel a service, we will refund any prepaid amounts. Refunds for completed work are evaluated on a case-by-case basis.
Intellectual Property
All Landscaping designs, plans, and proprietary materials created by Armidale Community Garden remain our intellectual property until full payment is received. Upon payment, you receive a license to use the design for your property. Our website content, including text and images, is protected by copyright and may not be reused without permission.
Limitation of Liability
Armidale Community Garden is not liable for indirect, incidental, or consequential damages arising from our services, such as plant failure due to extreme weather or pre-existing soil conditions. Our liability is limited to the cost of the service provided. We carry insurance for direct damages caused by our negligence.
Warranties
We warrant our Landscaping workmanship for one year from completion, covering defects in installation. Plants are guaranteed for 90 days against failure due to improper planting, provided our care instructions are followed. This warranty does not cover damage from neglect, animals, or acts of nature. All warranties are void if payment terms are not met.
User Conduct
When using our website or services, you agree not to engage in any unlawful, abusive, or fraudulent activity. You must provide accurate information and respect our staff and property. We may terminate service or website access for violations of these conduct standards.
Governing Law
These Terms of Service are governed by the laws of the jurisdiction where Armidale Community Garden operates. Any disputes will be resolved through mediation or in the local courts. We aim to resolve issues amicably and encourage direct communication before pursuing formal action.
Changes to Terms
We may update these Terms of Service to reflect changes in our business practices or legal requirements. The updated date at the top indicates the last revision. Continued use of our services after changes constitutes acceptance. We will notify you of significant changes via email or a notice on our website.
